This Informed Consent and Liability Waiver ("Waiver") is an agreement between you ("Participant," "you") and Gymsanity LLC ("Gymsanity," "we," "us"). By signing electronically during onboarding (or on the consent page), you acknowledge that you have read, understood, and agree to this Waiver.
Assumption of risk
Physical training, coaching, group or 1:1 sessions, mobility work, and related activities involve inherent risks, including but not limited to muscle strains, joint injuries, cardiovascular events, falls, equipment-related injury, and in rare cases serious injury or death. You voluntarily participate with full knowledge of these risks.
Not medical advice
Gymsanity coaches and programs are not medical care. Content in the app (including estimates, recovery scores, or programming) is educational and coaching-oriented only. You are responsible for obtaining medical clearance before beginning or continuing exercise, especially if you have injuries, conditions, or take medications that may affect training safety.
Your responsibilities
- Disclose relevant health history, injuries, and limitations to your coach honestly.
- Stop any exercise that causes unusual pain, dizziness, chest pain, or distress, and seek care.
- Follow safety instructions and use equipment only as directed.
- Provide accurate account information and keep emergency contacts current where applicable.
Release of liability
To the maximum extent permitted by law, you release, waive, and discharge Gymsanity LLC, its owners, coaches, employees, contractors, agents, and affiliates from any and all claims, demands, damages, losses, or causes of action arising out of or related to your participation in training, coaching, sessions (in-person or remote), use of facilities or equipment, or use of the Gymsanity Service — including claims based on negligence (but not gross negligence or willful misconduct where such waiver is prohibited by law).
Indemnification
You agree to indemnify and hold harmless Gymsanity and its affiliates from claims arising from your breach of this Waiver, your misuse of the Service, or your failure to disclose material health information.
Electronic signature
Typing your full legal name and checking the acknowledgment box constitutes your electronic signature and has the same force as a handwritten signature. We store the timestamp, waiver version, and name you provided with your account.
Governing law
This Waiver is governed by the laws of the State of Delaware, USA, except where mandatory consumer or personal-injury laws in your place of residence require otherwise. If any provision is unenforceable, the remaining provisions remain in effect.
